1) You MUST be
over 18 years old to fill out these documents.
mental capacity in order to fill out the Advance Healthcare Directive (AHCD) and Durable Power of Attorney (DPOA) documents. If you don’t, they are invalid.
3) The statutory
AHCD MUST be witnessed by two people who are NOT your named Healthcare Agents.
4) If you are in a skilled nursing community, you must also get the
Ombudsman to sign the form.
5) The statutory
DPOA MUST be notarized.
6) If you have assets or children (or both), you need more than these statutory
documents to make sure your wishes get honored and your family avoids court.
